Who we are

PEM TOURS & Travellers is a car hire, safari and travel services business based at KFA, Jacaranda Business Complex, Room G32, Nakuru, Kenya. We decide how and why your information is used, which makes us the data controller for the purposes of the Data Protection Act.

What we collect

We only collect what you type into our booking forms or tell us directly. Depending on the form, that includes:

• All booking requests: your name, phone number, email address, the dates and places you want to travel, number of travellers and any notes you add.
• Car hire: everything above, plus your ID number, driving licence number, pick-up and return details, and whether you want a driver.
• Car hire guarantor and next of kin: their name, phone number, occupation and ID number (see below).

Each request is given a reference number (for example PEM-123456) and saved with the date and time it was sent. The travel guide chat on our site answers from within your browser; what you type into it is not sent to us or stored.

Like any website, our hosting and the third-party services listed below may see technical details such as your IP address and browser type when your browser loads a page.

Why we use it

• To respond to your enquiry, check availability, confirm your booking and arrange payment instructions. This is necessary to take steps you have asked for and to carry out the agreement with you.
• For car hire, to prepare the hire agreement and to verify the hirer, the guarantor and the next of kin before a vehicle is released.
• To keep business, tax and accounting records, and to meet legal obligations, including requests from the police or courts where the law requires it.
• To protect our vehicles and business from fraud, theft and unpaid hire charges.
• To contact you about your booking. We do not send marketing messages unless you separately ask us to.

We do not sell your personal information and we do not use it for advertising or automated decision-making.

Guarantors and next of kin

If you give us another person's details on a car hire form, you confirm that you have told them and that they are happy for us to hold and use their details to verify the hire and to contact them if needed. They have the same rights as you do under this policy.

Who we share it with

Only authorised PEM TOURS staff can open bookings, and the staff dashboard requires a login. We share information outside the business only where it is needed:

• Google (Firebase): our booking requests are stored in a Google Firebase database. Google acts as our service provider. Its servers may be outside Kenya, so your data can be transferred abroad. We rely on Google's security commitments and use it only to run our service.
• Vercel: our website files are hosted by Vercel Inc., a hosting provider based in the United States. When your browser loads a page, Vercel's servers process technical details such as your IP address. Its servers may be outside Kenya.
• Google Fonts and Google Maps: described under Cookies below.
• WhatsApp: if you tap a WhatsApp link, your message goes through WhatsApp under its own privacy terms.
• Authorities: police, courts or regulators where the law requires it.

Payments are not taken on this website. M-Pesa payment details are sent to you by our team after we confirm your booking.

How long we keep it

We keep booking and hire records for as long as we need them to deliver the service, resolve disputes and meet our accounting and legal record-keeping duties. After that we delete the records or remove the personal details from them. Ask us if you want to know the retention period that applies to your booking.

How we protect it

Booking data is stored in a password-protected system that only authorised staff can sign in to, and the website is served over an encrypted connection. No online system is completely risk-free. If a breach affecting your data occurs and it is likely to cause you harm, we will tell you and the Office of the Data Protection Commissioner as the law requires.

Your rights

Under the Data Protection Act you can ask us to:

• tell you what personal data we hold about you and give you a copy;
• correct data that is wrong or out of date;
• delete your data, where we no longer need it for the reasons above;
• stop or restrict how we use your data, or object to a particular use;
• give you your data in a commonly used format so you can take it elsewhere.

To use any of these rights, email info@pemtours.co.ke or call us, and quote your booking reference if you have one. We may need to confirm who you are first. If you are unhappy with our response, you can complain to the Office of the Data Protection Commissioner of Kenya at www.odpc.go.ke.

Cookies

Cookies are small files a website saves in your browser. We keep their use to a minimum and we do not use advertising or tracking cookies.

Essential items are needed for the site and booking forms to work, so they are not switched off by your choice. You can change your mind at any time:

Children

Our services are meant for adults. Car hire requires a valid driving licence, and we do not knowingly collect personal data from anyone under 18 without a parent or guardian making the booking.
